Toss Terms of Use

These Terms of Use (“Terms”) govern the use of the mobile application Toss (“the App”), provided by Deltacontra (“we,” “us,” or “our”).

By using the App, you agree to these Terms. If you do not agree to these Terms, please do not use the App.

1. About the App

Toss is a simple application that allows users to write out what is on their mind and then toss it so that the text disappears without being stored.

The App is not intended to provide a journal, record-keeping service, emotion log, AI analysis, habit-management service, or similar functionality.

2. Text Entered in the App

Text entered into the App is deleted after it is used for the Toss experience.

The App does not provide a feature for storing, viewing, restoring, or analyzing text after it has been tossed.

You should not use the App as the sole means of storing information that you may need later, important information, or information that must be retained as a record.

3. Free Version

The Free version generally allows one Toss per day.

The daily usage limit is managed based on the date of your device and usage information stored locally on your device.

Changes to your device's date or time settings, reinstallation of the App, or other circumstances may cause the usage limit to behave differently from normal.

4. Toss Pro

Toss Pro is a one-time paid feature available through an in-app purchase.

Toss Pro removes the Toss usage limit and provides access to Pro background experiences. Background experiences are displayed randomly in accordance with the App's functionality.

Toss Pro is not a subscription and does not incur recurring charges.

We may modify the content, visual experiences, design, or other specifications of the App or Toss Pro through updates or for other reasons. Nothing in these Terms is intended to unfairly restrict rights that cannot be restricted under applicable law.

5. Purchases and Payments

Toss Pro purchases are made through the in-app purchase systems provided by the Apple App Store or Google Play.

The price displayed by the applicable store or within the App at the time of purchase applies. Prices may vary by region, currency, taxes, store settings, or other circumstances and may change in the future.

Payments are processed by Apple or Google. We do not directly collect or store credit card numbers or other payment credentials.

6. Purchase Status and Restore Purchases

The App uses RevenueCat to retrieve Toss Pro product information, verify purchase status, and restore purchases.

Purchase restoration is performed using the restore functionality provided in the App together with purchase information maintained by the applicable store.

Verification or restoration of a purchase may require the Apple App Store, Google Play, RevenueCat, or other relevant external services to be available and functioning normally.

7. Refunds

Refunds, cancellations, and other matters relating to purchases of Toss Pro are handled in accordance with the terms and refund policies of the Apple App Store or Google Play through which the purchase was made, as well as applicable law.

Nothing in these Terms limits any right to a refund, cancellation, or other remedy that you may have under applicable law.

8. Notifications

The App may display notifications only if you choose to enable notifications and select a notification time.

Notifications may not be delivered at the expected time due to device settings, operating system behavior, power-saving features, or other circumstances.

9. Prohibited Conduct

You must not:

• violate applicable laws or public order;
• interfere with the normal operation of the App or our systems or services;
• attempt unauthorized access or otherwise compromise the security of the App;
• unlawfully copy, modify, analyze, or redistribute the App or any part of it beyond what is permitted by applicable law;
• infringe the rights or legitimate interests of us or any third party; or
• engage in other conduct that we reasonably determine to be inappropriate.

10. Medical and Health Disclaimer

The App is not a medical device, medical service, psychotherapy service, diagnostic tool, or treatment.

The App and its content are not intended to replace medical or other professional advice.

If you are experiencing a medical emergency or otherwise require professional assistance, do not rely on the App and seek appropriate professional or emergency assistance.

11. Intellectual Property

Copyrights, trademarks, and other intellectual property rights relating to the App, including its software, design, images, videos, audio, text, logos, and other content, belong to us or to third parties that lawfully hold such rights.

These Terms do not transfer any such rights to you.

12. Changes, Suspension, and Discontinuation

We may modify, suspend, or discontinue all or part of the App for reasons including improvement, maintenance, security, technical requirements, or business considerations.

Where reasonably possible, we will seek to provide appropriate notice of material changes or discontinuation.

13. Disclaimer of Warranties

We do not guarantee that the App will be suitable for any particular purpose, complete, accurate, continuously available, or produce any particular effect or result.

You use the App at your own discretion and responsibility.

Nothing in this section excludes any warranty or right that cannot lawfully be excluded or limited under applicable law.

14. Limitation of Liability

To the extent permitted by applicable law, we will not be liable for damages arising from the use of or inability to use the App.

This limitation does not apply where liability cannot lawfully be excluded or limited, including where required by applicable consumer protection laws or in cases of our intentional misconduct or gross negligence.

15. Privacy

The handling of user information is governed by the separate Toss Privacy Policy.

16. Changes to These Terms

We may update these Terms in response to changes in applicable laws, the functionality of the App, external services, or other circumstances.

If these Terms are updated, we will revise the “Last updated” date on this page. If a change is material, we may also provide notice through this page or another appropriate method.

17. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan.

Any dispute relating to the App or these Terms will be subject to the jurisdiction of the courts of Japan, except where applicable law requires otherwise.
